Please read these Terms carefully. The Site presents original generative audiovisual artworks and information about experiencing, commissioning, licensing, or acquiring them. A purchase, commission, installation, or license is governed by a separate written agreement.
1. Acceptance of these Terms
These Terms of Service (the "Terms") govern your access to and use of waveboxstudio.com and its content and features (the "Site"), operated by waveBOXstudio. By accessing or using the Site, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Site.
You must be legally capable of agreeing to these Terms. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization.
2. Purpose and availability of the Site
The Site introduces waveBOXstudio's Infinite Audiovisual Art, displays live or recorded examples, and provides information about artworks, editions, formats, installations, authenticity, provenance, acquisitions, and commissions.
We may change, suspend, remove, or discontinue any part of the Site or any displayed stream at any time. We do not promise that the Site, a stream, or any particular feature will always be available, uninterrupted, error-free, or compatible with every device, browser, display, or audio system.
3. Art, content, and intellectual property
The Site and the works and materials presented through it—including audiovisual compositions, live and recorded outputs, software-generated imagery and music, algorithms, source and executable software, text, photographs, graphics, logos, names, designs, and arrangement—are owned by waveBOXstudio, the artist, or their licensors and are protected by intellectual-property and other laws.
"waveBOXstudio," the waveBOXstudio logos, work titles, and related branding may not be used in a way that suggests sponsorship, affiliation, or endorsement without prior written permission. No rights in an artwork, software, source code, edition, or brand are transferred merely because you access the Site.
4. Limited permission and acceptable use
We grant you a limited, revocable, non-exclusive, non-transferable permission to access the Site and view or listen to its content for personal, informational, and non-commercial purposes.
Unless we give prior written permission or a separate license expressly allows it, you may not:
- copy, download, record, reproduce, modify, distribute, publicly display, publicly perform, broadcast, retransmit, sell, sublicense, or commercially exploit Site content or an artwork;
- extract, scrape, frame, mirror, or systematically collect content or data from the Site;
- reverse engineer, decompile, circumvent, or attempt to discover the source code, algorithms, security, access controls, watermarking, serial numbers, or authenticity mechanisms of any software or work;
- interfere with the Site, introduce malicious code, overload infrastructure, or attempt unauthorized access; or
- use the Site or its content unlawfully, deceptively, or in a way that infringes another person's rights.
5. Inquiries, commissions, acquisitions, and licenses
Descriptions of artworks, formats, editions, installation options, authenticity measures, or availability are invitations to inquire and do not by themselves constitute a binding offer, guarantee, or sale. Contacting the studio does not obligate either party to proceed.
Any acquisition, commission, hardware package, installation, service, cloud or server deployment, audiovisual export, commercial use, license, support arrangement, certificate, or provenance registration is subject to a separate written quotation, invoice, license, sale agreement, or other contract. If that separate agreement conflicts with these Terms, the separate agreement controls for that transaction.
Prices, taxes, delivery, installation requirements, edition details, permitted uses, support, warranties, and transfer or resale conditions will be established in the applicable agreement.
6. Nature of generative artworks
waveBOXstudio artworks may generate music and visuals procedurally and in real time. Their appearance, sound, sequence, duration, and output vary by design. Website demonstrations, recordings, photographs, and sample iterations illustrate the character of a work but do not promise an identical future output.
Statements such as "infinite," "never the same," or "never repeated" describe the artistic and procedural design of the work; they are not mathematical guarantees that no output, frame, note, pattern, color, or combination could ever resemble or match another.
For authorized editions or installations, any serial number, cryptographic hash, watermark, certificate, or provenance record identifies the applicable delivered build or copy according to its accompanying documentation. It does not transfer copyright or other intellectual-property rights unless a written agreement expressly says so.
7. Third-party services and links
The Site may embed or link to YouTube and other third-party websites, players, platforms, or services. We do not control and are not responsible for their content, availability, security, data practices, or terms. Your use of a third-party service is governed by that provider's terms and policies.
8. Disclaimers
To the fullest extent permitted by law, the Site and all Site content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory. We disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and quiet enjoyment.
Nothing on the Site is legal, financial, tax, investment, conservation, installation, electrical, or technical advice. You are responsible for obtaining appropriate professional advice and confirming that any proposed installation or use is suitable for its intended environment.
9. Limitation of liability
To the fullest extent permitted by law, waveBOXstudio, the artist, and their service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or use, arising from or related to the Site or these Terms.
To the fullest extent permitted by law, our total liability for claims arising from or related to the Site or these Terms will not exceed US$100. These limitations do not apply where prohibited by law and do not limit rights that cannot legally be waived.
10. General terms
We may update these Terms by posting a revised version with a new effective date. Your continued use of the Site after an update means you accept the revised Terms.
If any provision is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect. Our failure to enforce a provision is not a waiver. You may not assign your rights under these Terms without our written consent. These Terms and the Privacy Policy are the entire agreement regarding your general use of the Site, except for any separate written agreement that applies to a transaction.
These Terms are governed by the laws that apply at waveBOXstudio's principal place of business, without regard to conflict-of-law rules, except where mandatory consumer law provides otherwise. Any dispute must be brought before a court with competent jurisdiction, unless the parties agree to another lawful resolution process.
